Session Description:

Although many lawyers and mediators think about using mediators only toward the end of a case, after discovery and motions, to finally resolve it, mediators can be very helpful at all stages of litigation –even before suit is filed.

This session will describe the “prison of fear” that leads lawyers and their clients to procrastinate about negotiation – and how they can escape from this prison to start negotiating, both as to process and resolution, at the earliest appropriate time.

Then it will describe a wide range of services that mediators can provide throughout a case to help parties and lawyers reach a satisfactory, cost-effective conclusion.

Session Description:

Climate change and security or economic conflicts are making the fight against poverty harder. Capital flows are more difficult to control, applications of available resources are difficult to optimize or channelized, and developmental goals are difficult to be attained. The eyes of the world are on these challenges. India and other emerging economies are typical examples to see these issues in that perspective, thus the developmental policies adopted by these economies need to take strategic approach to climate change, conflict and capital, which are key factors affecting development and the fight against poverty. This webinar tries to see these conflicts, development needs, the resources allocations, and further tries to identify the solution approach, may that be through policy or through application of technology.

Although the global development policies are to help countries gain control over their own development, and to help individuals gain control over their own lives, the rapid and alarming negative effects of climate change and the unified response observed in the near past have created a paradox in terms of UN Millennium Development Goals and country obligations to climate response. The webinar will take an example of energy and resources crisis faced by India, to understand this paradox, and will try to zero-in on possible way forward.

"Computers are useless, they can only give you answers." Pablo Picasso. Questions are a mediator's most important tool. Questions can offer new perspectives, the possibility of better choices and synthesize our understanding. This open and interactive webinar will explore the nature of questions using Asking Better Questions, Bloom's Taxonomy of Learning Domains and 4MAT: Teaching to Learning Styles. These 3 models offer a structure for understanding how we perceive the world around us. This session will help mediators reflect on the questions they have asked and the questions they will ask in the future. "We thought that we had the answers, it was the questions we had wrong."
Session Description:

Since the beginning of the century, Peru has experienced significant political and social changes, largely a result of the end of armed conflict, the introduction of neoliberal policies, and the increase of corporate investment to extract raw materials (mainly metals). Marked increases in the price of metals enticed most major mining companies to start exploration projects. While subsequent improvements in the economy led to Peru being declared as one of the fastest growing economies of Latin America, with economic growth also came an increased number of social conflicts and destructive consequences that threatened the core of Peru's democracy. Communities and extractive companies, mostly in the highlands, were forced to coexist, facing the challenge of building a collaborative relationships based on trust. This webinar deals with experiences of the Peruvian NGO ProDiálogo in promoting -- in an impartial manner -- effective consensus building processes, mostly between mining companies and local comunities. Some challenges and lessons learned will be shared.

Session Description:

The peacebuilding field has struggled to adapt traditional international development funding and project design processes to the inherently complex issues of conflict transformation. Much of the work has been focused on fixing what we are doing now. But what if we take an entirely different worldview when working with local organizations to design grassroots efforts? Drawing from resources such as Ricigliano’s systemic peacebuilding, CDA’s Reflecting on Peace Practice, and Wheatley and Freize’s work on communities, networks and emergence, emergent peacebuilding design provides an alternative inquiry into the characteristics of sustainable community conflict transformation, as exemplified in Kenya’s Laikipia Peace Caravan. This webinar will introduce an emergent peacebuilding design inquiry framework, and explore its use by external partners to more effectively fund, evaluate and support grassroots projects.
