<p class="MsoNormal"><span style="">Individuals and organizations alike have leveraged Information and Communication Technology (ICT) to promote peace and resolve disputes in zones of prolonged conflict. The use of ICT offers a number of advantages in the peace building process. For example, social networking tools foster virtual communities, providing a new avenue for previously isolated people to access information and resources outside the zones of conflict. Each community has its own rhythm and access to technology, as is the case with Internet Bar Organization's (IBO) PeaceTones Initiative. Take a quick peek at the Facebook based online contest (<a href="http://www.facebook.com/haitisings">www.facebook.com/haitisings</a>) and VOTE (to help select the Haitian artists who will make the finals), to see one such example.</span></p>
<br/>
<p class="MsoNormal"><span style="">The IBO’s PeaceTones Initiative addresses the isolation of individuals in conflict zones and areas recently freed from conflict. Prolonged conflict serves as an anchor, holding back populations vandalized and deprived of resources, populations living at or below the international poverty line, and populations overlooked or exploited by local governments.</span></p>
<p class="MsoNormal"><span style=""> </span> <br/></p>
<p class="MsoNormal"><span style="">PeaceTones aims to assist musicians and their communities in conflict and post-conflict zones with access to Internet technology, legal assistance in establishing and maintaining intellectual property rights, alternative dispute resolution assistance to ensure successful ongoing development, and business assistance to bring remote market prices to local developing markets.</span><br/></p>
<p class="MsoNormal"><br/></p>
<p class="MsoNormal">PeaceTones through a number of ICT platforms has successfully created virtual communities, which enable their focus groups to access information and resources beyond their boundaries. The parties had a meeting and exchanged various emails. <br/> <br/> The price was agreed at $1,500. The website was to be finished in 2 weeks. <br/>
<br/>
The website was finished and handed over after 4 weeks and an invoice issued. No payment has been made, other than a $250 deposit, and Cornercut are threatening to issue court proceedings for the balanceof $1,250. <br/>
<br/>
According to Mr DeMandin, it was agreed that the website would include a database that would link to a map and so locate, and send an email to, a building contractor nearest to, and of the category required by, the enquiring client. <br/>
<br/>
Cornercut deny such was included, albeit some early mention that was not followed up by either party and , they say, not agreed to by them. Their staff does not have the necessary expertise in any event. <br/>

Graham co-founded the first Online Dispute Resolution service in the UK, WeCanSettle, and designed the blind bidding software at the heart of the system. Graham subsequently founded TheMediationRoom.com, for whom he designed their online mediation platform which operates on bespoke software developed specifically to meet the needs of both online mediation and arbitration. Graham is a Fellow of the National Centre for Technology and Dispute Resolution and speaks regularly at international conferences on the impact of the law on the Internet and e-commerce and on the application of technology to ADR. Graham was host of the 5th International Conference on Online Dispute Resolution held in Liverpool, UK, in 2007 . Graham was a member of the Working Party of the European Committee on Standardisation (CEN) which developed a taxonomy for Online Dispute Resolution and currently is a team member of the EMCOD<br/>
project (<a href="https://cumail.creighton.edu/exchweb/bin/redir.asp?URL=http://www.emcod.net/" target="_blank">www.emcod.net</a>) which is creating a facility for the European Union for the measurement of justice through ODR . What makes people trust one another? How do we decide whether to trust one another in negotiation? Over the past twenty years, Eileen has mediated hundreds of cases in a wide range of subject matters including business, partnership, employment/workplace, probate and estates, and family law/divorce. She has taught mediation and conflict resolution courses at UC Berkeley School of Law, UC Hastings College of Law, Sonoma State University and John F. <p class="MsoNormal">Michael Cote is an environmental planner specializing in Climate Change Adaptation for coastal communities. He is working on a book and several articles covering the intersection of land-use law and climate adaptation policy. Adapting to climate change involves complex land-use laws, private property rights, and intense negotiations. He attended the negotiations at the United Nations Climate Change Conference (COP15) in Copenhagen this past December with the Vermont Law School delegation. <span style="" xml:lang="EN-GB" lang="EN-GB">In the Netherlands, several</span> mediation service providers are using hybrid forms of Juripax-ODR technology in labor and employment disputes. In contrast to ODR processes which take place exclusively online, here ODR is used to support the traditional offline procedures. <span style="" xml:lang="EN-GB" lang="EN-GB">Specifically, the participants are asked to fill in an online intake before attending the face-to-face mediation. The answers</span> are only sent to the mediator (asynchronous mediation). Actually one could describe this as some kind of pre-caucusing in order to prepare for the face-to-face mediation.<p></p>

<span style="font-weight: bold;">CASE STUDY</span><br/><div style="border: 1pt solid windowtext; padding: 1pt 4pt;"><br/><div style="border: 1pt solid windowtext; padding: 1pt 4pt;"><p class="MsoNormal" style="border: medium none; padding: 0in;"><i style=""><span style="" xml:lang="EN-GB" lang="EN-GB">Mrs. Johansson (working in the internal sales department) and Mr. Eckstein (supervisor) are going through a nasty conflict. The past 2 months, Mrs. Johansson has been sick-listed. So far, the tones of the discussions were largely reproachful and failed to produce any kind of solution. Consequently, the dispute is referred to the Human Resources office which recommends mediation.</span></i> <br/></p>
<br/><p class="MsoNormal" style="border: medium none; padding: 0in;"><i style=""><span style="" xml:lang="EN-GB" lang="EN-GB">Instead of participating immediately in a face-to-face mediation, the mediator decides to use an online tool to support the face-to-face interactions. Reasons for the mediator to use an online intake are the problematic relationship but especially the destructive communication. As the textual and delayed communication provides people with time to reflect without experiencing the external pressure of the other party, the use of the online tool in escalated conflicts can be very helpful. It may be helpful to cool down and to reframe the situation.</span></i><br/></p>

As the discussions became more constructive, there were two concluding face-to-face discussions.</span></i></p>

As a practitioner in dispute resolution, Bryan draws on his experiences and education to assess the existent dynamics, engage the relevant parties in dialogue, reframe the negative to the appreciative, and bring a sense of calm to the room to assist in the facilitation of group dialogue and resolution of interpersonal conflicts. He has a B.S. from Minnesota State University – Mankato in Speech Communications, and an M.A. from John F. Kennedy University in Organizational Psychology with a graduate certificate in Conflict Management. Prior to joining the Werner Institute, Bryan was a university administrator in the San Francisco Bay Area where he also devoted substantial time to work as a mediator, facilitator and trainer in conflict resolution. Bryan also currently serves the Creighton University community as a member of the distance education review committee.</p>
