The New Jersey Senate has passed legislation that would make the state a center for international alternative dispute resolution.

The bill, S602, sponsored by state Sen. Thomas Kean, R-Union, passed in a 33-0 vote Sept. 15 and now goes to the Assembly for consideration.

The bill, if passed by both houses of the Legislature and signed by Gov. Chris Christie, would codify a process in which disputes between U.S.-based and foreign-based parties could be resolved through arbitration or mediation.

"This is exactly the kind of legislation to make New Jersey more hospitable to the business community," Kean said in a statement.
Surrounding the acorn are mementos and photos of Ann’s vibrant life: Ann in a black and white prom dress; Ann wearing a purple princess hat surrounded by colorful balloons on her last birthday; and Ann swaddled in a blanket on her mother’s lap shortly after she was born.

As many of you know, I’ve been (unsuccessfully) trying to become a decent tennis player, and now the moment has come when I know all hope is lost: My 12 year-old can play me under the table.

Despite this, I decided she and I would “team up” and play doubles against two friends of mine who are about our level. And, all was going well – until I messed up a few times. Well, this upset my daughter to the point that she mumbled, “I didn’t want you on my team in the first place.” Yep. It hurt.

But, it got me thinking: She would NEVER treat a stranger like this. I’ve watched as other doubles partners mess up over and over again, and she doesn’t seem to mind at all. So, what gives? Why do my loved-ones treat strangers better than they treat me? And why do I do the same?.. Find out more here.

By Chris Voss (Posted in Quora and Huffington Post, 09/14/2016)

Here are three things that are both practical and give you the power to distinguish yourself:

#1. Don’t be afraid to find out: amplify and clarify. This will get you to the point where you’ll learn to listen between the lines and find out what makes people really tick. You’ll make great deals and have great allies. Learning to read people and then make that knowledge useful in your negotiations in a way that benefits your negotiation partners eventually makes you become someone who can make deals others can’t. You become the “fixer”, that is, the go-to person who they send in to succeed when no one else can.

By Jeff Glaze (09/12/16. Wisconsin State Journal)

By Lester Levy

This article discusses early cooperation between parties and insurers in resolving complex environmental disputes. It summarizes strategies that recently succeeded in a six-way dispute over the costs of investigating and remediating an extended plume of PCP groundwater contamination. It moved rapidly from a traditional lawsuit to a voluntary mediation process aimed at identifying the most economical and reliable remedial approach to cleaning up the contamination, and allocating the costs of doing so among all parties. Although the parties agreed to refrain from traditional court-mandated procedures, they retained the right to try the case if the cooperative process was unsuccessful in resolving all disputed issues. Ultimately the process was successful and the need for trial was eliminated. See more here

Toxic workplaces are characterised by broken relationships, constant conflicts and disputes, bullying and harassment. They are places where the dysfunctional behaviour of those in the workplace is having a negative impact on the services or product that the organisation produces. It’s moved beyond a minor tiff between John and Sally and is now a systemic problem whereby customers aren’t being looked after, patients aren’t being cared for, roads aren’t being repaired or information isn’t being passed between security guards. Even more frightening, a toxic workplace knows no boundaries – it can seep in from the front line right up to the top.

How can things get so bad?
The commander of the Revolutionary Armed Forces of Colombia announced Sunday that his fighters would cease hostilities beginning at 12:01 a.m. as a result of the peace accord the two sides reached at midweek. Colombian President Juan Manuel Santos made a similar announcement Friday, saying the military would halt attacks on the FARC beginning Monday.

The government expressed hopes that a peace agreement could be reached within a year after the Oslo talks, the first formal meeting for five years.
By Gretel Kauffman (09/01/16. The Christian Science Monitor)

In 1838, Georgetown University in Washington, D.C., sold 272 slaves, a sale that rescued the university from dire financial straits. Now, nearly 200 years later, in an attempt to atone for this sale and the years of slave labor from which Georgetown benefited, the school has introduced a set of measures that includes an initiative that offers preferential admission status to descendants of those held in slavery by the university.

Georgetown is far from the first school to publicly denounce its past ties with slavery or take steps to atone for historic wrongdoings. A number of colleges including Brown University, the College of William and Mary, and the University of North Carolina at Chapel Hill have created commissions, built memorials, and funded research projects to open a dialogue about the role of slaves in the universities' respective histories. But Georgetown is the first to actively recruit the descendants of the people it wronged.

Myth: Divorce Mediation Only Works When Spouses Can Communicate Well

Fact: If that were true, CMDR would be out of business. It is the mediator’s job to facilitate communication between spouses. A skilled mediator can draw out the less communicative party and help him or her vocalize ideas. The mediator is the catalyst in bringing about negotiation, compromise and agreement. However, it is the couple that decides what is fair and emerges as better communicators as a result of the mediation process.

Myth: The Divorce Process Moves Faster with Attorneys

Fact: The logistics of one spouse meeting with his attorney, and then waiting for the other spouse to meet with her attorney to review a proposal and come back with any changes are overwhelming and time consuming at best...

Elizabeth Esrey- I enjoy the people I work with immensely. They may not realize it but I often learn more from them then I suspect they learn from me. Each mediation renews my belief that people are willing to listen, learn and create resolution in the interest of peace, time, and fiscal responsibility.

People ask how I succeed in getting so many mediation agreements. Frankly, I don’t gage the success of a mediation based on getting an agreement...

There is no guarantee that a mediation will yield an agreement. Over my twenty plus years of mediating, I am less focused on that. Instead, the greatest benefit of mediation is the opportunity to have a difficult but direct conversation in a safe place where various opinions are heard and considered. The listening and learning that comes from mediation, is often the greatest gift.

Because we are independent, families can be confident that we are there for them without any competing interests. We provide impartial yet knowledgeable information and through our network we can help families to solve the problems they will face along the way. We often work with families who have nowhere else to turn.

We do this through seminars, in-house training sessions, providing expert speakers for events and scenario sessions. We want to use our experience to help organisations provide the level of care, support and assistance that we do.
