Yesterday I realized how ChatGPT, a free and popular AI (Artificial Intelligence) app, can help mediation trainees practice and hone their skills.

In short, I asked ChatGPT to play the parties’ role (Landlord and Tenant sent to mediation by a judge) in a simulation with me playing the mediator’s role.

Obviously, these simulations have some limits. For example, they are text-based (rather than online or in-person). And they are “virtual”, with no real persons playing the parties’ roles.

And yet, I believe that this tool might be useful to mediation trainees. Right after their basic mediation training, they could run as many simulations as they like - by themselves, on their time and at their pace.

If you’re interested to take a look at what an online mediation simulation with ChatGPT looks like, please send me an email. I’d be glad to send you yesterday’s transcript (in pdf format).

Thank you.

About the Elder / Adult Family Mediation Training:

As families face issues related to aging, they often grapple with important decisions about a range of topics such as living arrangements, care giving, driving, family communication, medical care, Powers of Attorney / Health Care Proxies / Guardianship / Conservatorship, financial planning, estate planning, family real estate, and personal property distribution. Conversations around these issues can be emotionally charged and complex.

This program teaches mediators skills and techniques for:

- Working with families in conflict around these and other issues,

- Convening multi-party family mediations, and

- Facilitating consensus.

Cases involving adult families are challenging and rewarding on a number of levels. The skills, techniques, and principles discussed in the training are transferable to mediation in other contexts, and past participants have often remarked about the mediation “gems” they have received and “aha moments” they have experienced that have helped deepen their mediation work.

Join trainers Arline Kardasis and Crystal Thorpe, along with guest presenters, for sessions packed with content, skill-building, role plays, and opportunities to interact with fellow participants.
What Previous Participants Are Saying:

"Thank you all for the excellent program… - the presentations were excellent, the materials just the type of thing that I will use in the future as a reference tool. Obviously you have devoted much time, thought, and effort to creating this workshop - your work has paid off for the participants!"

“You offered a great training, and one that opened windows both into eldercare practice and your inclusive, evolving approach to mediation. You are trailblazers and I’ve already thought of ways to incorporate a number of your approaches into certain circumstances that may arise more generally in mediation. So, again, all my gratitude.”

“Elder Decisions®’ Advanced Elder Mediation Training...was excellent; actually the best I have ever experienced. It was well organized (and) the subject matter was completely covered. (This was) the most sequentially programmed and clearly presented (training) I have yet attended.”

“This exceeded my expectations! The Elder Decisions® Mediation Training makes a compelling case for why we need to step up to this national challenge and makes it possible for mediators to step into these critical but delicate family conversations. I got a great return on my investment: information-dense, practical, inspiring — allowing me to extend my company’s services to meet this growing demand.”

"I'm still raving to everyone how valuable I found the training and how I enjoyed all of the presenters."

On September 13, 2022 a group of mediators participated in a 1-hour Free Zoom webinar presented by Giuseppe Leone (yours truly) titled “Online Mediation - How to Create Quickly a Good Rapport with the Parties”.

3 KEY TAKEAWAYS OF THIS WEBINAR

1 - In online mediation, what matters most are the mediator’s skills, experience, and personal qualities. That’s because learning the “online” part takes only a few hours or days of practice. On the contrary, becoming an effective mediator takes several years of training, experience, and self-reflection.

2 - Once a mediator clearly understands the parties’ expectations, needs, and feelings when they participate in an online mediation - especially for the first time - it’s much easier to figure out what to do, when, and how in order to create a good rapport with them.

3 - Two of the above parties’ most crucial expectations are not only that they feel “in good hands” (i.e. their online mediator knows what he or she is doing); but also that they believe that their mediator truly cares about them.

During the webinar we discussed several techniques useful in 2 different scenarios that require creating quickly a good rapport with the parties.

SCENARIO 1: When a mediator is scheduled to mediate online a case with two or more parties (and their legal or union representatives), who have already agreed to pay for his or her mediation services.

SCENARIO 2: When two people (potential clients), who have never participated in mediation before, book a 30-min Free mediation consultation via Zoom on a mediator’s website. In just 30 minutes, that mediator needs

> To connect, create a good rapport with those potential clients

> To explain to them clearly the benefits of mediation (compared to their other options: i.e. assisted negotiation, arbitration or trial)

> To convince them to hire him or her as their mediator.

Not an easy task. Therefore, mediators who participated in my webinar also learned that, if they want, they can sharpen their rapport-creating skills by participating with other mediators in Free 1-hour online mediation simulations- as explained on my website

WHAT YOU'LL LEARN

To begin with, I’ll share with you many tips and techniques that I’ve been testing and fine-tuning since 2016, mediating online with my clients - among them, the United States Postal Service - and teaching online mediation via Zoom to groups of mediators around the world.

Next, you’ll learn why those tips and techniques are not enough. Creating a good rapport with the parties when you mediate online also requires a clear understanding of their specific needs, feelings, and expectations of you. That understanding is just a mediation skill, which you can practice with fellow mediators - online and for Free.

NO REGISTRATION REQUIRED

(Feel free to share the Zoom link below with other mediators).

Mediate.com has published an article that I wrote to share with fellow mediators 3 important lessons I learned after my retirement from mediation practice. I learned those lessons accidentally, by reading some good books on mediation and human nature/behavior.

Those books not only helped me understand better (belatedly) the parties’ and my own behavior in mediation.

They also made me realize two other things. First, that during my mediation practice I had fallen into two traps - I called them the “Lack of Curiosity Trap” and the “Complacency Trap”. And second, that for more than 20 years there had been a big, inexplicable “disconnect” - between how I had been trying to help other people resolve their conflict, and how I had been trying to resolve conflict in my personal life, at home.
