<p><span style="font-size: 12pt;">Yesterday I realized how ChatGPT, a free and popular AI (Artificial Intelligence) app, can help mediation trainees practice and hone their skills.</span></p>
<p><span style="font-weight: 400; font-size: 12pt;">In short, I asked ChatGPT to play the parties’ role (Landlord and Tenant sent to mediation by a judge) in a simulation with me playing the mediator’s role.</span></p>
<p><span style="font-weight: 400; font-size: 12pt;">Obviously, these simulations have some limits. For example, they are text-based (rather than online or in-person). And they are “virtual”, with no real persons playing the parties’ roles.</span></p>
<p><span style="font-weight: 400; font-size: 12pt;">And yet, I believe that this tool might be useful to mediation trainees. Right after their basic mediation training, they could run as many simulations as they like - by themselves, on their time and at their pace.</span></p>

That’s because learning the “online” part takes only a few hours or days of practice. On the contrary, becoming an effective mediator takes several years of training, experience, and self-reflection.</span></p>
<p><span style="font-weight: 400;">2 - Once a mediator clearly understands the parties’ expectations, needs, and feelings when they participate in an online mediation - especially for the first time - it’s much easier to figure out what to do, when, and how in order to create a good rapport with them.</span></p>
<p><span style="font-weight: 400;">3 - Two of the above parties’ most crucial expectations are not only that they feel “in good hands” (i.e. their online mediator knows what he or she is doing); but also that they believe that their mediator truly cares about them.</span></p>

And second, that for more than 20 years there had been a big, inexplicable “disconnect” - between how I had been trying to help other people resolve their conflict, and how I had been trying to resolve conflict in my personal life, at home.</span></p>

<p>Online Mediation: Turning Mediators' Initial Skepticism Into Enthusiasm </p>
<p>Conflict Intervention Service (CIS) <a href="https://goo.gl/YBwTq8">https://goo.gl/YBwTq8</a> is a grant funded project of the City and County of San Francisco in partnership with The Bar Association of San Francisco’s Bay Area Mediation Services Program. This innovative program utilizes skilled mediators with diverse backgrounds in landlord-tenant law, psychology, addiction, mental health and housing conflict to resolve disputes in affordable housing that can lead to eviction or homelessness.</p>
<p>On November 2, 2017 a group of those mediators participated in a Virtual Mediation Lab Hands-on Training in Online Mediation, which consisted of 2 parts:</p>
<p>>> Part 1 – 60-min Introduction to Online Mediation (What online mediation means and how It works; how we (mediators) can do online everything we are used to do face-to-face; how to blend face-to-face and online mediation; which cases are suitable for online mediation; online mediation benefits; which video collaboration software works best for online mediation.</p>
<p>>> Part 2 – 90-min Hands-on Online Mediation via Zoom (Each mediator practiced what they learned during Part 1)</p>
<p>At the end of the training, I asked all mediators a simple question: “Has this 150-min hands-on training changed your view of online mediation?” Here are some of their answers:</p>
<p>“Now I am not afraid of it”<br/>“I am eager to do it”<br/>“I am marveling at the capabilities of this software (Zoom). It’s incredible.”<br/>“I’m excited at the way people perceive technology and their relationship with technology. Online mediation may add an edge to mediation”.<br/>“This is extraordinary”<br/>“It opens up a whole new world!”</p>
<p>This experience seems to show that a good way to respond to many experienced mediators’ initial (and natural) skepticism about online mediation is to let them try it and judge by themselves.</p>

<p><span style="font-family: 'times new roman', times;" class="font-size-3">This forum is dedicated to discussion of issues related to the Future of Mediation project, described below:</span></p>
<p class="paragraph" align="center"><span style="font-family: 'times new roman', times;" class="font-size-3"><b>The Future of Mediation</b> </span></p>
<p class="paragraph"><span style="font-family: 'times new roman', times;" class="font-size-3">This project, undertaken jointly by Noam Ebner and Alyson Carrel, seeks to forecast the future of the mediation field and the practice of mediation. We’ve mapped out the change processes currently underway and identified the potential for changes in areas including: the provision of professional services, the actors in mediation processes, the design and delivery of mediation services, traditional process management, models, values, and worldviews, as well as conflict itself.<i> </i> Some of these change processes have already clearly begun; others, we suspect, lie just around the corner. Most of these change processes are driven by the effects of the technological upheaval of the past couple of decades on people, processes, industries and society; other causes converge with technology to catalyze change. Each change-process, in its own self, is significant to the field and its practitioners. Combined, they portend a sea change in the world of mediation. To remain helpful and relevant in a changing world, mediation must adapt as a field, and individual mediators must evolve as practitioners. Our project seeks to illustrate the future of the mediation field, and to characterize and prepare the new mediator who will thrive in it. </span></p>
<p class="paragraph"><span style="font-family: 'times new roman', times;" class="font-size-3"> At the field-level, the ramifications of the changes we've noted may justify, or require, reconsidering such top-level issues as the focal point of the field's identity, the nature and role of its organizations, the ethics of the field, and more. They also invite revisiting of its various areas of practice such as systems design, community work, and court-connected practice. Perhaps new sources of cases might be identified, and new long-term partnerships formed. </span></p>
<p class="paragraph"><span style="font-family: 'times new roman', times;" class="font-size-3"> In terms of preparing the new mediator (including, preparing the seasoned practitioner for future practice) these changes require consideration of the field's educational and preparatory pathways and content. What new competencies are required, for conducting the mediation cases of tomorrow? What professional pathways might be available, for tomorrow's practitioner? </span></p>
<p class="paragraph"><span style="font-family: 'times new roman', times;" class="font-size-3">Our exploration offers an opportunity to revisit seminal questions in the field, such as the question Bernie Mayer posed in Beyond Neutrality (2004): Why do people not seek out the services of the conflict resolution world, or view them as relevant to the problems of the day? We hope to come up with a new, meditation-centered, response which envisions new practice for mediators, and a rebooted approach to mediation that is both of value and valued, appealing to parties to conflict as well as to conflict practitioners. Other core issues and well-known debates in the mediation field will be reviewed anew, in light of the societal and professional shifts affecting the field. These include the role of conflict and the value of settlement, the centrality of neutrality to mediation work, the role of the mediator in ensuring fair, stable, and socially desirable outcomes, and the role of mediator and case evaluations. In (re)visiting these issues, we hope to provide new frames through which they can continue to inform and improve the mediation field. </span></p>

<p>Second, given that most people already have and use regularly a mobile device, online mediation can open up new business opportunities, especially for young, innovative mediators.</p>
<p>To demonstrate those two benefits of online mediation, Virtual Mediation Lab is seeking college students trained in mediation, willing to play the mediator’s role or the role of one of the parties/roommates in 3 online mediation simulations in October 2017.</p>
