India - Chief Justice advocates mediation to solve complex commercial disputes

The Indian Express reports that the Cief Justice of India, speaking at a national conference, stated that mediation is a sounder mechanism to resolve “complex” commercial disputes involving the pricing of natural resources like gas and oil, because judges may lack the expertise and their decisions could affect the country’s economy.


At the same conference the president of the Mediation and Conciliation Project Committee of the Supreme Court said that when a dispute is resolved through mediation, there is no winner or loser, for the parties agree to the solution whereas in litigation there is always a loser.


The Law Minister said mediation enjoys a success rate of 42%.
