arbitration from both the advocate's and the arbitrator's perspective.
E-discovery, like or not, is becoming increasingly prevalent (and
increasingly expensive) in arbitration discovery. With the advent of
"paperless" transactions, the use of electronic data and filing
systems, and the use of email as the primary form of communications,
e-discovery is replacing "paper discovery" as the tool of choice in
arbitration discovery. Ask yourself, how times recently have you heard
about cases where emails are the most important (or most quoted)
evidence?

With e-discovery coming to the fore, arbitration proceedings often have as their most controversial aspect the scope and cost of
e-discovery. On the one hand, advocates believe that e-discovery is a
potential "gold mine" of evidence; on the other hand, arbitrators must
balance wide-ranging discovery requests against the goals of speed and
efficiency in the arbitration process.
