I would like to see mediation used more broadly in areas that routinely resort to arbitration such as reinsurance, contractual arbitration of commercial disputes and other such areas. I am involved in those areas as a mediator and am finding that as arbitration has become more expensive , time consumming and complex, there is a growing willingness for the parties to explore mediation as a way for them to resume control over their own dispute resolution process.
